L'incipit dell'Act è:<br />
''WHEREAS great delays have been used by sheriffs, gaolers and other officers, to whose custody, any of the King's subjects have been committed for criminal or supposed criminal matters, in making returns of writs of habeas corpus to them directed, by standing out an alias and pluries habeas corpus, and sometimes more, and by other shifts to avoid their yielding obedience to such writs, contrary to their duty and the known laws of the land, whereby many of the King's subjects have been and hereafter may be long detained in prison, in such cases where by law they are bailable, to their great charges and vexation.''

"CONSIDERANDO che grandi ritardi sono stati usati dagli sceriffi, dai carcerieri e da altri ufficiali, alla cui custodia, uno qualsiasi dei sudditi del Re è stato commesso per reati o presunti reati, nel fare rimpatri di atti di habeas corpus diretti, indicando uno pseudonimo e ha plasmato l'habeas corpus, e qualche volta di più, e con altri turni per evitare la loro arrendevole obbedienza a tali scritture, contrariamente al loro dovere e alle leggi conosciute della terra, per le quali molti dei sudditi del Re sono stati e l'aldilà potrebbe essere detenuto a lungo in prigione , in questi casi dove per legge sono disponibili, con le loro grandi accuse e vessazioni".
Il diritto all'"H.C." fu una volta per tutte consacrato grazie al ''[[Bill of Rights]]'' della [[Gloriosa rivoluzione]] inglese del 1688-89; da qui è poi passato in tutte le [[costituzione|costituzioni]] liberali occidentali (cfr. ad esempio Il "Bill of Rights" allegato alla [[Costituzione degli Stati Uniti d'America|costituzione americana]], articoli 7 e 8, c. d.
